UKLGIG has been concerned as to the use and recording of the correct gender in the case of transgender persons in the asylum process. As a rule, the gender at birth is used by the Home Office. Transgender asylum seekers come from countries where being transgender is a cause for persecution and where access to gender-affirming surgery treatment or gender recognition is limited or non-existent. We are concerned that mis-gendering in the asylum process perpetuates the discrimination which gave cause to the persons to seek asylum.
